Welcome to Miniland. The companies in its group and affiliates ("Miniland") provide you with access to the Miniland website (the "Website") and sell you its products under the terms & conditions set out on this page.
Complete access to the web pages of the website requires you to register first as a user once you have accepted the General Terms & Conditions. After said registration, you will be regarded as a Member and will thus form part of the so-called "Private Community of Miniland".
Terms & Conditions pertaining to your use of the Miniland Website
1. Your Account
When you use the Website, you will be responsible for maintaining the non-disclosure of the data and the password of your account and restricting access to your computer to avoid any possible unauthorised uses of your account. You agree to assume total liability for any activity carried out from your account using your password. You must take all the measures required to ensure that the password remains secret and safe. You must inform us forthwith if you have reason to believe that your password has been informed to a third party, that it has been used in an unauthorised manner or is liable to be used in that way.
Check that the data you have provided us with are correct and complete and inform us forthwith if there is any variation in the information you provided us with when you registered. You may access your information and update it through the Your Account section of the website.
Miniland reserves the right to deny any access attempt to the Website, to cancel accounts, eliminate or modify content or cancel any orders in the event that you fail to comply with the applicable legislation, the present General Terms & Conditions or any Specific Terms & Conditions or other terms & conditions or policies of Miniland. In the event that we cancel an order, this will not entail any expense for you.
3. Access to the Miniland Website
Miniland shall make every effort to ensure that access to the Website is uninterrupted and that transmission is free of any errors. However, owing to the nature of the Internet, we cannot fully guarantee this. What’s more, access to the Website may sometimes be temporarily suspended or restricted to carry out repair or maintenance tasks or for the implementation of new tools or services. We will try, as far as possible, to minimise the frequency and duration of each of these access suspensions and restrictions.
4. License for access to the Website
Miniland grants you a limited license for access to the Website for your personal use, but not to download content (except for the downloading of pages in the cache memory) or its total or partial modification, unless the specific consent of Miniland is obtained in writing. Said license does not include the right to resale nor of the commercial use of the Website nor its contents, nor the right to draw up or use any list of products, descriptions or prices. Nor does it include the right to carry out any other use deriving from the Website or its contents, not to download or copy information about accounts for the benefit of some other trader, nor for the use of data mining and search tools or robots.
It is not permitted to reproduce, duplicate, copy, sell, resell, nor exploit in any way the Website nor any part thereof for commercial purposes without our specific prior consent in writing.
It is not permitted to use framing techniques to introduce any trademark, logo or other information protected by industrial or intellectual property rights (including images, text, designs of pages or formats) of Miniland and the companies in its group without the attendant prior consent in writing. The use of meta tags is not permitted nor the use of any other "hidden text" that uses the names or registered trademarks of Miniland or the companies of its group without the prior consent of Miniland in writing. Any unauthorised use thereof shall entail cancellation or the permission or license granted by Miniland.
Miniland grants you the limited, revocable and non- exclusive right to create a hyperlink to the Miniland home page provided that said link does not represent Miniland, companies of its group or its products in a manner which is false, erroneous, denigrating or offensive in any other way. It is not permitted to use any Miniland logo nor any other registered trademark or graphic as part of the link without our specific prior consent in writing.
5. Conduct of the user
You may not use the Website in a way that causes, or may cause, the Website or access to it to be interrupted, damaged or deteriorated in any way.
You must be aware that it is you, and not Miniland, who is responsible for any electronic communication and content sent from your computer to Miniland and that you must only use the Website for licit purposes.
It is not permitted to use the Website for:
· fraudulent purposes or purposes related with offences or illicit activities of any type
· send, use or reuse any material which is illegal, offensive, abusive, indecent, defamatory, obscene or threatening in any way or which entails a breach of intellectual or industrial property rights, including copyright and registered trademarks or non-disclosure, privacy or any other right, or which is in any other way insulting or objectionable to third parties, or whose content has computer viruses, political propaganda, advertising, chain e-mails, mass e-mailing or any other type of spam,
· generating any type of unnecessary discomfort or inconvenience
6. Communications and other contents
Website users may send communications, suggestions, ideas, comments, questions or other information provided that the content is not illicit, obscene, abusive, threatening, defamatory, violates third-party privacy, infringes intellectual or industrial property rights or is insulting or objectionable in some other way to third parties and does not contain any computer viruses, political propaganda, advertising, chain e-mailing, mass e-mailing or any other type of spam. It is not permitted to use false e-mails, to impersonate the identity of another person or entity, or lie in any other way about the origin of any content. Miniland reserves the right (though it shall not have the obligation) to delete or modify any content.
When you send any type of material, and unless stated otherwise:
· (a) you grant to Miniland and the companies of its group a non-exclusive, free right of use - which is wholly sublicensable and transferrable - to use, reproduce, modify, adapt, publish, translate, create and exploit any derivative works and the distribution and display of said content worldwide and on any media; and
· (b) you grant to Miniland and the companies of its group and sublicensees the right to use the name that you have used with regard to said content if they decide in this way. You agree that said rights bestowed are irrevocable throughout the period of protection of your intellectual property rights associated with the content and material mentioned above. You agree to waive your right to be identified as the author of said content and your right to object to any mistreatment of said content. You agree to carry out all the actions required to formalise any of the aforementioned rights that you have bestowed on Miniland, including the signing of contracts and documents, at the request of Miniland.
You declare and guarantee that you yourself are the owner or control by other means all the rights to the content you are sending and that, on the date on which the content or material is sent to Miniland: (i) the content or material is accurate; (ii) the use of the content or material you are providing does not clash with any of the applicable policies or guidelines of Miniland and shall not entail any loss to any person or entity (including that the content or material is not defamatory). You agree to hold Miniland and the companies of its group harmless for any claims lodged by third parties against Miniland or the companies of its group which arise from or are related with any breach of these guarantees.
7. Claims owing to defamation
In view of the fact that Miniland publishes thousands of products for sale at the Website, it is not possible for us to review the content of each of the products for sale. This is why Miniland acts in line with a “warning and withdrawal” mechanism. If you believe that any of the contents of the Website, or content published thereat, is in any way defamatory, please inform us immediately, completing the form that you can find here. Once you have completed this procedure, Miniland shall start the relevant actions to delete the defamatory content which is the object of the claim within a reasonable period.
8. Intellectual and industrial property rights and data base rights
Any content hosted at the Website such as, for example, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software are owned by Miniland, the companies of its group or its suppliers of content and it is protected by the laws of Luxembourg and international laws on intellectual and industrial property rights and data base rights. All the content of this Website is solely owned by Miniland and the companies of its group and it is protected by Spanish and international laws on intellectual property rights and data base rights. All the software used at this Website is owned by Miniland and the companies of its group or by our software suppliers and it is protected by the laws or Spain and international laws on intellectual and industrial property rights.
The systematic extraction or reuse of parts of contents of the Website is not permitted without the specific consent in writing of Miniland. In particular, the use of data mining and search tools or robots is not permitted for the extraction (on one or several occasions) of substantial parts of this Website for its reuse without the specific consent in writing of Miniland. Neither is it allowed to create nor publish its own data bases when the latter contain substantial parts of this Website (for example: our product lists and price lists) without the specific consent in writing of Miniland.

Miniland Baby, Miniland Educational and any other logos, buttons and graphic images that appear at our Website are registered trademarks or trademarks of Miniland or of its subsidiaries (collectively called, for these purposes, "Miniland") in the European Union or other jurisdictions. The graphics, logos, page headers, button icons, scripts and service names of Miniland are registered trademarks or the commercial image of Miniland. The registered trademarks and commercial image of Miniland may not be used with regard to any product or service that does not belong to Miniland, nor is any way liable to cause confusion amongst our clients or which may disparage or discredit Miniland. The other registered trademarks which are not owned by Miniland and which appear at this Website belong to their respective owners who may or may not be affiliated or related in any way with Miniland or sponsored by Miniland.
